Pixo — Privacy Policy

Cue Apps Inc., a corporation incorporated in Ontario, Canada ("Company," "we," "our," or "us"), operates the Pixo photo sharing platform ("Service"). This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use the Service, whether as an event host ("Host") or an event guest ("Guest"). Please read this Privacy Policy carefully. By using the Service, you consent to the practices described herein.
If you do not agree with the terms of this Privacy Policy, please do not access or use the Service.
1. Information We Collect
1.1. Information You Provide Directly
Host Account Information. When a Host creates an account, we collect the information provided during registration, which may include your name, email address, and password.
Guest Information. When a Guest scans a QR code to join an event, we collect the name the Guest provides. Guests do not create accounts, and we do not collect a Guest's email address.
User Content. We collect the photographs, images, and videos you upload to the Service ("User Content").
Communications. If you contact us for support, to report content, or for any other reason, we collect the information contained in your communication, including your name and email address.
1.2. Information Collected Automatically
When you access or use the Service, we may automatically collect certain information, including:
Device and Browser Information. We may collect information about the device and browser you use to access the Service, such as device type, operating system, browser type, and browser version.
Log Data. Our servers may automatically record information when you use the Service, including your IP address, access times, pages viewed, and the referring URL.
Analytics Data. We use third-party analytics services (such as Google Analytics) to help us understand how Users interact with the Service. These services may collect information about your use of the Service, including pages visited, time spent on pages, and navigation patterns. 1.3. Cookies and Similar Technologies
The Service may use cookies and similar tracking technologies to facilitate the operation of the Service and to collect analytics data. You can control or disable cookies through your browser settings, though doing so may affect the functionality of the Service.
2. How We Use Your Information
We use the information we collect for the following purposes:
To Provide and Operate the Service. We use your information to facilitate photo uploads, make User Content available to the applicable Host and authorized viewers, manage accounts, and otherwise deliver the core functionality of the Service.
To Communicate With You. We may use your email address to respond to inquiries, provide customer support, send service-related notices, and notify you of changes to the Service or our policies.
Checkout Reminders. If you begin a purchase and provide your email address but do not complete the payment, we may send you a short series of reminder emails about your unfinished checkout. Every such email includes an unsubscribe link, and unsubscribing stops the series immediately. This is also disclosed where the email address is collected.
To Improve the Service. We use analytics data to understand how the Service is used, identify trends, diagnose technical issues, and improve the performance and features of the Service.
To Enforce Our Terms. We may use your information to investigate potential violations of our Terms of Use, to detect and prevent fraud or abuse, and to protect the rights, property, and safety of Cue Apps Inc., our Users, and the public.
To Comply With Legal Obligations. We may use or disclose your information where required to comply with applicable laws, regulations, legal processes, or enforceable governmental requests.
We do not use your User Content (uploaded photos) for marketing, advertising, artificial intelligence training, or any purpose other than making them available to the applicable Host through the Service.
3. How We Share Your Information
We do not sell, rent, or trade your personal information. We may share your information in the following limited circumstances:
With Hosts. User Content uploaded by Guests, along with the Guest's name, is made available to the Host of the applicable event album. This is a core function of the Service.
With Service Providers. We may share your information with third-party service providers who perform services on our behalf, such as hosting, data storage, payment processing, email delivery, analytics, and customer support. These service providers are contractually obligated to use your information only for the purposes of providing services to us and in accordance with this Privacy Policy.
For Legal Purposes. We may disclose your information if required to do so by law, or if we believe in good faith that such disclosure is necessary to comply with a legal obligation, protect and defend our rights or property, prevent fraud, protect the safety of Users or the public, or respond to a government request.
Business Transfers. In the event of a merger, acquisition, reorganization, bankruptcy, or sale of all or a portion of our assets, your information may be transferred as part of that transaction. We will notify you of any such change in ownership or control of your personal information.
With Your Consent. We may share your information with third parties when we have your explicit consent to do so.
4. Data Storage and Security
4.1. Storage Location
Your information, including User Content, is stored on cloud infrastructure provided by Cloudflare, Inc. Your data may be stored and processed in data centres located outside of Canada, including in the United States. By using the Service, you consent to the transfer of your information to facilities outside your jurisdiction, including to jurisdictions that may not provide the same level of data protection as your home jurisdiction.
4.2. Security Measures
We implement reasonable administrative, technical, and physical security measures designed to protect your information from unauthorized access, disclosure, alteration, and destruction. However, no method of transmission over the Internet or method of electronic storage is completely secure, and we cannot guarantee absolute security. You use the Service at your own risk.
5. Data Retention
We retain your personal information and User Content for as long as reasonably necessary to provide the Service and fulfil the purposes described in this Privacy Policy, unless a longer retention period is required or permitted by law. Specifically:
Host Account Information is retained for as long as the Host maintains an active account with the Service.
Guest Information and User Content is retained for the duration of the applicable event album's existence on the Service. Hosts may request deletion of their event albums and all associated User Content and Guest information by contacting us.
Analytics and Log Data may be retained in aggregated or anonymized form for a longer period for the purposes of improving the Service.
When personal information is no longer required, we will delete or anonymize it. Residual copies may persist in backup systems for a limited period before being permanently removed.
6. Your Rights and Choices
Under applicable Canadian privacy legislation, including the Personal Information Protection and Electronic Documents Act (PIPEDA), you have certain rights with respect to your personal information:
Access. You may request access to the personal information we hold about you.
Correction. You may request that we correct any inaccurate or incomplete personal information.
Deletion. You may request that we delete your personal information, subject to certain exceptions permitted by law.
Withdrawal of Consent. You may withdraw your consent to our collection, use, or disclosure of your personal information at any time, subject to legal or contractual restrictions. Please note that withdrawing consent may affect your ability to use the Service.
Analytics Opt-Out. You may opt out of Google Analytics tracking by installing the Google Analytics Opt-out Browser Add-on or by adjusting your browser's cookie settings.
To exercise any of these rights, please contact us using the information provided in Section 10. We will respond to your request within a reasonable timeframe and in accordance with applicable law. We may need to verify your identity before processing your request.
7. Children's Privacy
The Service is not directed to children under the age of 13 (or the age of digital consent in the applicable jurisdiction, whichever is higher). We do not knowingly collect personal information from children under this age. If we become aware that we have collected personal information from a child under the applicable age threshold, we will take steps to delete that information promptly. If you believe that a child has provided us with personal information, please contact us immediately using the information provided in Section 10.
8. Third-Party Links and Services
The Service may contain links to third-party websites or services that are not owned or controlled by Cue Apps Inc. This Privacy Policy does not apply to such third-party services. We are not responsible for the privacy practices of any third-party websites or services, and we encourage you to review the privacy policies of any third-party services you access.
9. Changes to This Privacy Policy
We may update this Privacy Policy from time to time to reflect changes in our practices, technology, legal requirements, or other factors. If we make material changes, we will provide notice by posting the updated Privacy Policy on the Service and updating the "Effective Date" above. Your continued use of the Service after any changes to this Privacy Policy constitutes your acceptance of the revised policy. We encourage you to review this Privacy Policy periodically.
